Buying Australian property from overseas can involve foreign-investment rules in addition to normal property, finance and tax considerations. The rules depend on the buyer, the property type and the proposed purchase.
Start with your buyer status
Before looking at a property, identify whether you are treated as a foreign person and check the current Australian Government requirements. Foreign persons generally need approval before purchasing residential real estate or land.
Current established-home restriction
From 1 April 2025 to 31 March 2027, foreign persons are generally prohibited from purchasing established dwellings, subject to limited exceptions. New dwellings, vacant land and other property types have different rules and should be checked before any commitment.
A practical starting checklist
- Confirm your residency and foreign-person status.
- Identify the property type and location.
- Check whether government approval, fees or registration apply.
- Obtain independent legal, tax and financial advice before making an offer.
